1. Introduction, general information.

Protection of the trade name of your product plays very important role – only a work package in the filed of protection of the intellectual property for that name can guarantee that your investments to marketing and advertising of the product will not be lost or used by competitors.

Usually, if company has introduced (registered) a new product to the market, performed active marketing activities, but has not performed a trademark protection – some products with similar names can appear and use the demand for your product.

State registration of the trademarks in Ukraine is performed by State Institute of protection of intellectual property – Ukrpatent. Certificate of trademark protection is valid for 10 years. After expiry of registration certificate can be renewed for the next 10 years.

Ukrainian classification system is created in accordance with “International classification of goods and services for registration of trade names” and separated into 45 classes.

Medicines are situated in the class 5:

Pharmaceutical and medicinal products, veterinary products, hygienical products and goods for medical (healing) purposes, dietary products for medical (healing) purposes, child meal, plasters and bandage materials, materials for dental filling, disinfection products, products for elimination of parasites and pests, fungicides, herbicides.

5 th class also includes:

•  hygienical products for personal use, except toilet;

•  deodorants, except personal;

•  medical cigarettes that do not contain tobacco;

5 th class not includes :

•  perfumes and cosmetic products (class 3);

•  personal deodorants;

•  orthopedic bandages;

Notice: during registration of the OTC product there is a sense to register trademark in additional 3 rd class (cosmetic products).

Medical devices, are generally listed in class 10:

Medicinal (medical), including surgical, dental and veterinary devices and instruments, artificial limbs, orthopedic devices, surgical materials.

10 th class also includes:

•  specialized medical furniture;

•  hegienical rubber devices;

•  orthopedic bandages;

Cosmetic products are listed in class 3:

Whitening products and other goods for washing, cleaning, polishing, degreasing and abrasive products, soap, perfumes, ethereal oils, cosmetic products, lotions for hairs, tooth pastes.

Standard procedure of trademark protection usually takes from 10 to 14 months. There is a way to speed up the procedure to achieve result in 7-8 months in the case if state and Cratia Ltd. fees will be increased.

Names of the competitor products must differ at least on 3 symbols from registered trade name.

2. Patent search (check of the name).

To reduce the risk of loosing time and money, we advise to perform the procedure of the patent search of the alike previously registered/submitted tradenames before submission of the Application for registration. Please note that patent search in not the obligatory stage of the tradename registration procedure.

Only at the finish of the registration procedure the name will be compared with other previously registered and submitted for registration names. In other words, if you submit the Application without preliminary search – you cannot be sure that trade name will be registered. Thus, in the case if expertise will decide that state fees will be lost.

Procedure of the preliminary patent search is simple (only application is required), quick (app. 2 weeks) and cost not much .

3. Prices .

3.1. Patent search of the alikeness of the tradenames.

Total price of the service is 150 EURO per one name, that includes state fees (app. 100 EURO) and service fee of Cratia Ltd.

In the case if you will order patent search of more than 3 names – we will provide you with serious discounts.

Time required for search – approximately 2 weeks.

3.2. Procedure of registration of the tradename.

Obligatory state fees:

a) for submission of the Application: 250 EURO (plus 120 EURO for every additional class);

b) fee for issue of the Certificate on the trade name registration – 180 EURO;

c) fee for publication of the tradename in the official journal in b/w color, per class – 25 EURO;

Total sum of the State fees : 455 EURO.

Services of Cratia Ltd:

•  for submission of the Application: 250 EURO;

•  for publication of the tradename in the official journal in b/w color – 150 EURO;

Total sum of Cratia Ltd. fees : 400 EURO.
